I dont believe the section you are talking about applies to Expo Holdings.

A lawsuit could be filed and Expo would not be immune to discovery. Last I checked they do not meet or report to a public accounting oversight board, but if they did then those documents and that communication would be immune.

That is my understanding of it at least.
