The holding company has never asked for the return of the assets. The holding company wants dollars for the value of the assets taken. Dollars are perhaps worth more in todays economy for bargain basement asset purchases. The holding company lawyers could have always tried to get temporary and permanent injunction to prevent the transfer of holding company assets...but have selected the dollar route instead. In the final analysis after damages are paid JPM may end up paying more than what wamu was worth at the time.
