Motion to Dismiss was entered 10/27/2009 This is not my normal response to a posting but since it was brought up…. THIS IS ALL IMO after reviewing the facts. Following the case since the Injunction Bond there have been several developments to date. When the plaintiffs were asked to produce evidence of wrong doing the XYNERGY case starting falling apart. In their feeble attempt to regain ground they filed an amended complaint after being reminded of the actual laws pertaining to the case. Subsequent to the review of the amended complaint a Motion to Dismiss was immediately filed. The case is closed. ALL MY OWN OPINION GOOOOOOO IFUS!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
