Robjer--As I tried to explain in my post, what was was issued is the final ruling by the ITC! After exercising review, it took no position on the validity issue. That is what I tried to explain in my post. There will be nothing further on it. IMHO
you are just wasting your energy going down the wrong path by beating on this validity thing. You clearly didn't read the ITC decision around validity and having no comment on it.
you need to reset back to the main focus of the future litigation... infringement.
you also need to recall the WM stated that his discussions with NOK center around money, not patents.
