Yes, they are guilty as charged, and that is not new at all, it is going on on and off in Corporate America from time immemorial. The process of converting a bright executive to a criminal is a slow process, of first stepping over the "ethical line" without stepping of the "legal" line, seeing that they can get away with it, and every time extending that step over, until suddenly, they find themselves in the zone of criminality. These people are personally very charming people, and with often "grand intentions" that their deeds will benefit not only themselves, but many others. However, they lack a moral compass, and without such a moral compass, many will stray over the line. I have seen that process time and time again when used to be part of "Corporate America", until the time became ripe to say, no more some 17 years ago.
