Brian Rosen: We intend to prove Fraudulent Transfer, Fraudulent Conveyance and we need to advance rule 2004 discovery, determine cause and action exist and wrap up 2004 in all cases.
They are trying to control and drag out the dispute to extract a more favorable settlement.
determine the business tort claim and prove that bad things lead to underminig value of WAMU.

Rosen: Your Honor JPMC is trying to dictate terms of 2004 coordination and discovery.
THJMW: I'm going to DENY the motion for reconsideration and STRONGLY SUGGEST need for coordination for discovery. Parties should be sensitive in repeating depositions. ( In other words, you'd better get it right the FIRST TIME!) I will Alllow 2004 in regards to Business Tort Calim. (FRAUD)

Friedman: WMI is wanting to submit our senior executives to multiple depositions and search files multiple times.
THJMW: I guess I'll get some discovery disputes then! Directing parties scheduling orders and coordinate, get docs, time to review and try to avoid duplication.

ANYONE WHO HAS LISTENED TO THE OMNIBUS HEARINGS CAN TELL THJMW IS VERY SHORT WITH S&C ATTORNEYS. SHE SEEMS TO GIVE WMI ATTORNEYS MORE LEE-WAY. I REALLY FEEL SHE IS ON OUR SIDE ON THIS AND KNOWS AN INJUSTICE WAS COMMITTED AND WILL HELP US ALONG TO PROVE IT. I WOULD THINK JPM'S BOARD WOULD NOT TAKE THAT CHANCE, I HOPE THEIR COUNSEL IS BEING HONEST WITH THEM INSTEAD OF SUCKING THE AMERICAN TAXPAYERS, THROUGH THE FDIC'S COFFERS FOR THE BILLINGS.
