Malko: NOK had plenty of time to set a rate with IDCC, but did not. So now they are subject to the rest of the industry setting a rate for them. I believe the arbitration panel, if equitable, will take into account that NOK/IDCC haven't been able to settle on a rate through there own negotiations, and take into consideration that others have settled on a rate with IDCC.
