A settlement works much different than a dividend. If JPM had announced that it wanted to buy out WMI for fair value then yes, they could have done it that way. Since it was taken to court, if there is a settlement it will be for the current shares out. Otherwise shares would not be trading right now and Weil would have done like GM and announced that current shares would likely be worthless in the end game and that has not happened.

Dividends (if paid) and settlement monies will go to shareholders of record at time of event. There simply will be a halt to the stock and it will reopen based on the settlement figure. If it is a stock swap, we will trade at a price the MM's set until such date as to commence the share exchange. If it is cash same can be said and we will receive offers from various interested parties to buyout WMI. Share value will increase as competitve bidding over the cash rich bones of WAMU comes to a conclusion. THJMW will have to approve any such deal, however, as long as all creditors get paid she would most likely leave WMI fate to WMI. WMI could elect to come out of BK and reinvent itself into a new banking entity. With $52B cash the possibilities are endless.
