Qualcomm announced today that a UK High Court has handed down a ruling in a patent lawsuit filed by Qualcomm against Nokia in May of 2006. Qualcomm alleged that Nokia had infringed on two of its patents in some Nokia handsets.

The patents in question involved Nokia's GSM/GPRS/EDGE-only handsets that don’t implement WCDMA and Qualcomm patents covering power saving and power control technologies. The UK High court ruled that the power saving patent held by Qualcomm is invalid and that the power control patent is only partially valid.

The portion of the Qualcomm power control patent the High Court found to be valid was ruled to not be infringed on by Nokia. Qualcomm says that it is considering whether it should seek permission from the UK court to amend the patents and appeal the decision.

That seems like an odd thing to me, Qualcomm loses the patent infringement case against Nokia with the court going a step further and saying not only did Nokia not infringe the Qualcomm patent, but Qualcomm doesn’t even have a valid patent. And then Qualcomm says, oh wait can we submit the patent again and give the suit another go.
