I am not quite certain the TOU is the problem. I think the arguement is that some posters seem to be given much more rope and much more leniency with the TOU.

For instance the spam rule used to read that one could not post the same or similar message more than two times in a 24 hour period. When a regular spammer was reported by me with 2 dozen violations of the spam TOU, the spam rule was reworded to "more than 2 times in a calendar day".

With that rewording the poster was spared dozens of violations that would have, or at least should have resulted in some sort of posting limitation.

Why would the rules be changed for the protection of 1 person? Spamming doesn't seem to be an issue for anybody other than the extreme pumper or basher. The rule was changed simply to protect the biggest TOU violaters on IHUB, spammers.

Now, this relates to the case against Matt because it shows, in a sense, that some preferential treatment is extended to certain posters under certain circumstances. One can find their post limited while spammers, when reported get the rules changed so that their clear violations are now within the rules.

Making it easier to spread spam which is normally used in the promotion of stocks. Like the SEC said, this is a penny stock website plain and simple. Setup for the presentation and promotion of penny stocks. It shouldn't come as a suprise to anybody that those who promote penny stocks bring in members. Those who like to expose penny stock fraud have to work much harder to keep their posts on the boards and their posting status intact. It is definitely harder for people like me to keep my message on a board than it is a promoter. I doubt anybody can really deny that honestly.
