A bit of due diligence. Another judge has been assigned to the foreclosure action brought by General Mortgage against CBAY and Pawson last year in Charlotte County Florida. Can't find any documents on file, but I presume that some kind of motion has been filed by Pawson and/or Cbay to set aside the deficiency judgment against cbay and pawson probably on the basis of bad service. The case was basically over once the judgment was entered, the clerks record now indicates "reopen", shows a new judge's name, and shows cbay and pawson's address as "confidential". I checked real estate transfers relating to the foreclosed properties and find that General Mortgage gave a 10% undivided interest in each and every lot to a corporation whose officers have the same last name (dubrow) as the lawyer who represented General Mortgage in the foreclosure action. My bet is that this was done to prevent cbay from regaining title to the property in the event there was no valid service on Cbay for the foreclosure. (Otherwise why wouldn't General Mortgage just transfer 100% of a couple of those lots to this corporation?) Cbay never made one payment on the mortgage it assumed to buy these lots, so I assume at this point cbay is just after getting the deficiency judgment set aside.
