But, when you are suing a scamster you expect him to be evil and devious. You plan for that type of behavior.
The property Eton owned was not transferred until over a month after the order was entered allowing the motion to file an amended complaint which would join Eton as a defendant. As I pointed out to nuffie a copy of the amended complaint that named Eton had to be attached to the motion according to the Local Rule. (This type of rule is rather standard throughout the entire US. The judge must see what you intend to file before he allows you to amend.) So, the complaint existed long before the order was entered. It's not drafted after the order is entered.
My point was this: Even lawyers just out of law school know that when the judge allows the amended complaint, you file it the same day the order allowing it to be filed is entered.
Frizzell and Koch waited a month. How could that happen and why did it happen were my questions to nuffie? Frizell and West always seem to be a day late. Coincidence, incompetence, indifference or hmmmmm? Whichever - more time and CMKX assets have been wasted unnecessarily, the one property is gone to the Murphy trust (the others may now have been scattered) and the CMKX legal follies continues as Frizzell chases his tail. ... eom
