Doesn't really matter, does it? A police officer can pull someone over for a taillamp out, then discover the operator is under the influence. Or smell pot, get a search warrant for the car and find guns, other drugs...ect, ect.
It matters little what got the SEC interested....once they open the books anything is fair game.
