Question..Can Nokia request an En Banc review in late summer assuming IDCC prevails ?.TIA

If there is oral argument, which is unclear at this point, it will likely be in the July time frame, with another period of time after that before a ruling. While in many cases it can take 6 months to over a year for a Circuit Court to rule, I expect given the "expedited" status of this appeal, it will hopefully be late summer.

Sjratty-With respect to your comment that you think oral argument on IDCC's appeal would be in July, I think it may be the middle of June based on the schedule:

4/18/08 EXPEDITED APPEAL Scheduling order #1 filed. Appellants brief due 5/5/2008. Appellees brief due 5/22/2008. Ready week 6/16/2008. [Entry date Apr 21 2008 ] [AJ]

The Second Circuit uses "ready week" as the week oral argument shall be ready to be heard.
