I wanted to follow up my conversation with Smith on Thursday re: pretrial
coordination issues.
Smith, thank you for your confirmation that InterDigital will not object to
the use of unsigned transcripts for those InterDigital witnesses for whom we
have not yet received signed transcripts. We would like to raise this on
Monday's call with Judge Luckern to obtain his approval. Ben and Alex,
please confirm that the Staff and Nokia have no objection.
Also, as Smith and I discussed, we think it makes sense for the parties to
talk Monday about witnesses who will appear live and the use of depositions
in lieu of live testimony to promote efficiency. We are available for either
an in-person or telephonic meet and confer at 5 pm ET. We will be prepared
to discuss the witnesses we expect to call live and the witnesses for whom we
think it makes sense to offer deposition testimony in lieu of live testimony.
If all the parties can be prepared to discuss these issues, we are hopeful
that the parties can reach some agreements on how to streamline the hearing.
Please let us know if that time works for InterDigital, the Staff and Nokia,
or if not, what time(s) on Monday afternoon would work.
