Spencer--I don't know when to expect a decision, because you have a 3 judge panel and someone may have to write a ruling. It could be that the staff motions law clerk has already reviewed the filings and written a memorandum for the judges that makes a recommendation. My hope is that because the record is absolutely clear that Judge Batts did not make the required findings of fact and legal conclusions on the record, that the recommendation is to reverse the preliminary injunction and remand it to her. If that is the case, then there would be a relatively short order from the panel. I know I will definitely be looking at the docket sheet tomorrow evening.
