mschere, I asked this in an earlier post but no one responded. Did Judge Bats set a date or deadline for IDCC to file for termination if the ALJ did not stay the proceeding against NOK? How long could they wait before they did that? TIA

Mschere. I agree.

Federal agencies are not white knights in shining armor.

If you file an action, they proceed to some conclusion.

If you terminate that action, they don't ask "Did you really mean that? Can't we pick up your sword and slay the dastardly villain?"

mschere: True. IDCC is required to file it, but that doesn't mean the judge has to grant it. We learned this in the Tessora (sp.) case that Whiz posted.

Plumear: We saw the Order and I believe the Motion to Stay was supposed to be filed today in the ITC. Maybe Olddog or Revlis will repost the order if my recollection is incorrect
