I am not an expert in this area and have to rely on others who know more such as paheka and lj.

Although abusive ‘‘naked’’ short selling
is not defined in the federal securities
laws, it refers generally to selling short
without having stock available for
delivery and intentionally failing to
deliver stock within the standard threeday
settlement cycle.2

This would indicate that naked short sellers are not now being prosecuted. I could be wrong.

revlis, do you know if there is any penalty for violating this rule? To often we see rules with not "teeth" in their prohibition. It would be good if this passes.
