This why the appeal is first to the commission and later to the Circuit Court of Appeals, both of which are fair more competent to hear the matters. It could well be that the patent serves both FDD and TDD in which case IDCC is entitled to license to Nok. Hopefully the IDCC lawyers will make the right points, but nothing is sure in litigation.
