maybe she thinks it is to the courts advantage to have a sword hanging over both parties heads. I am sure she has had enough of this on her docket and that she believes some sort of settlement is in order. If one party or the other acts beyond her sense of balance, the sword comes down. trial to the left and summary judgement to the right. where that balance lies is in the details

a chunk of change and sure would like to be free of PXD with some MGP that will aggressively work these sites. Does the trust have the ability to reach a different sharing agreement with a new MGP such as 50/50 etc. I hope it does but am clueless as to what the trust charter would allow.

The judge will not do that... (see Document 33528296) where Judge says the "The summary judgment record on defendants' pending motions is closed absent leave of court to reopen"

This is what a judge says to ensure no ambush or doubt is in the air about any motions and if or when they will be approved.

Great questions though!
