that case sounds like the patent holder AGREED to supply their patented tech at a determined price.After the tech was incorporated the patent holder than tried to get a higher rate than was previously agreed.I'd doubt that IDCC has any such issues in lieu of its recent agreements with LG,RIM and Apple.
