Re: More thoughts - Hosie communication
I called Hosie at 4:15 PM. He was unavailable and I left a lengthy VM identifying myself as a shareholder and asking a few things:

- Was this the end to ongoing negotiations with Real?
- Given that this is a preemptive strategy similar, if not identical, to that employed by Apple, is Burst considering taking a more "proactive" strategy and going more aggressively after other infringers (not likely to get a comment on strategy, and I said so in the message, but I asked anyway).

Left my home number for reply; left my office at 5pm, arrived home at 5:20 (yes, I work close to home); message from Hosie left just after 5pm stated the following:

-Burst is publicly traded, so he must be careful in all communications.
-That said, he will state that he will be handling/leading all Burst litigation going forward, and that he was not involved in the Apple case, but he was involved in the Microsoft case.
-Invited me to call back tomorrow morning to ask for any further details (which I will be doing).

First, thanks Mr. Hosie. I doubt highly he reads these boards, but perhaps he has an aide do that, and I want to state that the professionalism and human courtesy demonstrated in such a timely call back, on what must be an insanely busy day, says volumes about his personal integrity and work ethic.

Second, there was a subtext to his comments about not being involved in the Apple case, and now taking over "all future Burst litigation." And it was present in his tone as well as the words he chose. Though he did not come out and say it, the clear implication to my ears was that, "I kicked a** before, and I'm back to kick some more."

One of my questions tomorrow will be: why did he not handle the Apple case, and does he feel it was mismanaged, and if "yes," how might that affect future litigation.

BTW- I called the legal team of the Apple case last summer to get an update on the upcoming SJ when it was still pending. I eventually spoke to a junior associate who pretty much knew nothing and was obviously just on the phone to brush me off.

Night and day of a difference on involvement. The same on past successes. Let's hope Hosie brings this company back from the brink.

Strabuono, I disagree with your assertion (and billfish) that the shareprice will tank today..quite the opposite (hopefully)

There is no real "market" for BRST shares at the moment...hence we are not vulnerable on a "neutral" announcement.
I see it as a positive that we have, so quickly, another action coming, proves that we are still going forward despite the "setback" against APPL..
Hosie is representing BRST in ALL legal matters from now on.
Why would Hosie still represent BRST , if there was no meat going forward??
As for Billfishs comment re: Gordon Rock's departure from the BOD, he points out GR's affiliation with the cable industry...and that in itself might be a future conflict of interest in regards about the much talked DVR patent litigations?? Unfortunately I have not been able to find any information about Gordon Rocks present business venues, that would maybe bring some light into his decision to leave the BOD??
(that of course is all speculations)
All that said , I really do not see anything that would drive down the shareprice in the coming days!!!Quite the contrary!!
I for one am ready to load up IF the stock is going to "tank"
