A bit disappointed that Burst and its legal team let another negotiation process come down to the infringer taking the lead in the dance – just to turn a phrase. It has been widely speculated that Real had been spoken to – at past SHM, Lang was quoted as saying something to the effect of: “We are looking at multiple infringers” whenever he was asked who Burst might go after next – after Microsoft, that is. Everyone online put Real towards the top of the usual suspects.

I think Gordon and Billfish both have a point, but my gut instinct leans towards Billfish, this will be taken with a grain of salt by the market. Though below .20 seems a bit extreme. Considering book value and even another paltry 10 mill from Real, we are still worth aprox. .25 cash, and then there is the speculative premium of the DVR patents. I will just watch and see tomorrow at the open. It will be very telling whichever way it goes. If it does not do much (always a chance with this stock right now), then we’ll know the market is just yawning over the FTRT patents, and sees the only value in Burst is the DVR patents.

This is quite out of the blue, what with all the speculation about the DVR patents in play with Apple, and Macworld coming next week, it’s going to be a more interesting January, much more quickly, than I ever expected.
