Dick: Actually he didnt as of yet because the Judge Lynch wouldnt hear it. I'm sure it will come out eventually. Do you feel that FTD's are detremental to a small company and the influx of counterfeit shares dilute the true value of that company? Supply and demand is important to the valuation of any company. If you have individuals who create enough shares illegally to dilute the value of a small company, should the SEC go after them with at least as much fervor that they go after the company that has been victimized.

Whether or not USXP is the victim of this practice it appears that the concern is to go after the easier target and that is the publically traded and transparent entity of the victim. In other word's silence the complainer and the problem goes away.

The shadowy arena that is NSS and FTD's for years have been denied by the SEC and DTCC and others. Now just the oposite appears to be happening and the government entities are realizing that they can't protect them anymore and so they are taking the high road by saying it does exist and is a monumental problem. In the electronic age of trading circumventing Reg Sho may be the norm now. Nafarious individuals will adapt to changing rules and regs. Money at all costs rules......They levy fines that are pocket change to these indiviuals and they are perfectly willing to pay these to continue these practices in my opinion.
