That is correct. Tercica can sell Increlex off label. Iplex can not be supplied anywhere except Italy for ALS. Portx is one of the very few that understands the settlement on yahoo board. If you do not understand, rely on his post and disregard any to the contrary. The settlement agreement effectivly amounts to a court ordered injunction against Insmed ever supplying Iplex for certain indications without permission from TRCA/DNA. The agreement also prohibits Insmed from entering late stage clinical trials in Italy for ALS. Evidently TRCA/DNA thinks they have a horse in this race. The Mayo ALS clinical results will likely play a big part in this picture going forward. Depending on those results and Italian results a lot of negotiating will be needed between Insmed, TRCA/DNA, and CEPH for Iplex to ever come to market for ALS.
