How did we get to 9 patents?

"Mr Baxter and Mr. Turrini are in talks about the patents being sold to Calypso Wireless and the CLYW will have a portfolio total of 9 US Patents to offer many features to telecoms and ISP along with VoIP operators"

Is this supposed to include the 2008 patents that have not even been issued to Baxter?
