Bookert,

We had two comments come out in the last week.

One positive by the FCC "chairmen" Kevin Martin which stated "that worries of Sirius (NASDAQ: SIRI) and XM (NASDAQ: XMSR) forming a monopoly if they are allowed to merge are unfounded."

and a negative comment by the Commissioner Michael Copps who said that he isn't sure that the proposed merger of Sirus (NASDAQ: SIRI) and XM (NSDAQ: XMSR) should be allowed to continue.

My take is we have five who will vote (by the attached article).

Copps is highly possible to be a no. Martin is highly possible to be a yes (if he is one of the five to vote)

Even steven so far.

FCC Commissioner Questions Media Mergers

(financialwire.net via COMTEX) -- October 1, 2007 (FinancialWire) Federal Communications Commissioner Michael Copps said that he isn't sure that the proposed merger of Sirus (NASDAQ: SIRI) and XM (NSDAQ: XMSR) should be allowed to continue, and he questioned the legitimacy of Rupert Murdoch's takeover of Dow Jones & Co.

According to Copps media mergers require careful scrutiny to determine if they are in the public interest. Copps is one of five commissioners who would be voting on whether Sirus and XM should proceed in their merger.

There is currently no vote scheduled for the Dow Jones deal, despite Copp's claims that the merger may not be "friendly to localism and diversity" in the media.
