I guess it surprises me that Peter would put in a public email that he is still considering suing Sony-BMG, especially since they still may re-file against him. Who has the money? Who has the legal resources?

The phrase you quote from the update strikes a correctly chosen cautionary note. That is prudent and informative. On my reading, if Sony-BMG took that decision, presumably after hearing the opinions of their own attorneys, the real chances of a re-institution must be exceedingly low.
