if the court made this assertion, then it would carry the weight of the applicable law. yet, as a company statement isn't it more in the nature of an opinion (perhaps supported buy their corporate counsel's "interpretation"? and isn't that what has been leveled at MCCY in terms of the lack of third party verification of their revenue and contract based announcements? a court is certainly a credible third party opinion, but that is NOT what is contained in this announcement.
