Biocognisafe clarifies its relationship with the group of companies ECN Holding LLC, ECT-Effective Control Trucking LLC and Media City Corporation LLC (Pinksheets: MCCY.PK) and their president Raphaël Huppé.

Biocognisafe confirms that there are currently no standing legal or commercial agreements between our company and this group of companies.

Biocognisafe is the sole and unique proprietor of the System of Detection of Somnolence” otherwise known as SDS.

Two judgments in provisional injunction rendered by the Quebec Superior Court on September 6th and 14th 2007, against, in particular, M. Raphael Huppé and ECN-Holding LLC, ECT-Effective Control Trucking LLC and Media City Corporation LLC (Pinksheets: MCCY.PK), order:

To defendant Bruno Farbos not to work for one or other defendants Raphael Huppe, ECN Holding LLC, Media City Corporation or ECT-Effective Control Trucking LLC on a product copied or similar to the product called System of Detection of Somnolence (SDS).

To defendants Raphael Huppe, ECN Holding LLC, Media City Corporation or ECT-Effective Control Trucking LLC, not to use proprietary confidential information of Biocognisafe Technologies Inc. obtained from defendants Bruno Farbos and Egberto de Medeiros or otherwise in relation to the technology at the base of the System of Detection of Somnolence (SDS) and regarding the business strategies of plaintiff Biocognisafe Technologies Inc.

To defendants Raphael Huppe, ECN Holding LLC, Media City Corporation or ECT-Effective Control Trucking LLC not to represent verbally, by press releases or on websites, in particular the site www.ecnholding.com or by any other method that they or anyone other than the plaintiff Biocognisafe Technologies Inc. are in appearance holder of any rights regarding the technology at the basis of the product called System of Detection of Somnolence (SDS);

To defendants Raphael Huppe, ECN Holding LLC, Media City Corporation or ECT-Effective Control Trucking LLC to withdraw from their websites, in particular the site www.ecnholding.com, from their press releases and any other public information media, all references to the System of Detection of Somnolence (SDS);

Biocognisafe reaffirms that it is the sole and unique proprietor of all the rights, patents and patents pending on the « Method and apparatus for generating an indication of a level of vigilance of an individual », known commercially as the SDS. No individual or corporation may pretend to any rights on the SDS and there are currently no individuals or corporations who have the right to represent or distribute the SDS.
