The '768 patent doesn't appear to be listed.

First Samsung will have to convince the judge that '768 is relevant to the case.

Yes, Your Honor, I will
stick my neck out even further. The Qualcomm
improvement period under that license ended at
Qualcomm's election in March of 1995. It
covered inventions that were made before that
improvement period ended.
All of these inventions that are at
issue in this investigation were made after
and, therefore, are not the subject to the
Qualcomm license.
That's why I can be so firm
on this point.
