neilbolton, I agree, it is ridiculous to suggest that a company must sue another company for losses and expenses due to a contract inorder to write them off, there is no such requirement in the tax code, on the other hand, I can see the insurance company requiring it, especially if the contract in question required that Sunncomm/Mediamax cover liability for the product they were selling to SonyBMG, that is a very common clause in most such contracts.
