An appeal must be based on judicial error. So that's what Fluffy has to try to prove. I don't think it'll be easy. Frankly, I don't think it'll be possible. That's why I believe the court of appeals will refuse to hear the case. If they agree to hear it, then the whole thing will drag on for awhile longer.
