Since your here, I would like to tap into your wealth of knowledge. Please respond to the DD distracted scientist gave you. I'm curious how does a company (if they are not just saying their being shorted as an excuse) find out they are being shorted if the SEC rule that was posted is true?

Non-reporting pinky threshold securities are defined by a NASD rule - see http://www.pinksheets.com/marketactivity/reg_sho_list.jsp

That was from the original Reg SHO provisions. It was changed shortly thereafter. Non-reporting Pinkies appear on the list regularly.
