Janice, I don't want to start up a major thread on that subject... but,
that seems a little off....
I mean, in the fact that it (short shares) would have to be reported, or routed through the DTC....
to be even counted for the threshold list...
I think you hold to the stance that every MM is on the legit side of the law....
that is simply not true, and you know it...
who would report it?

Directly from the SEC:

"Threshold securities only include issuers registered or required to file reports with the Commission ("reporting companies"). Therefore, securities of issuers that are not registered or required to file reports with the Commission, which includes the majority of issuers on the Pink Sheets, cannot be threshold securities."

Additionally, "there are various reasons why an equity security with a large short position may not appear on an SRO's threshold securities list, for example: ...the majority of issuers quoted on the Pink Sheets do not file reports or register with the Commission, and so would not appear on threshold lists."
