#76518 RE: Texbanker #76517

From the 10-K just filed recently

PART II

Item 5. Market for Common Equity and Related Stockholder Matters and Small Business Issuers Purchases of Equity Securities

Lack of Market

Prior to our common stock qualifying for quotation on the Over-the-Counter Bulletin Board (the “OTCBB”) under the symbol “INDQ” in November 1999, the common stock only minimally traded. In 2000, our common stock was removed from the OTCBB. All trading activity is currently quoted in the “pink sheets” under the symbol “BCIT.” We were advised by DTC that it would not provide settlement services for transactions in our common stock due to the existence of Invalid Certificates. We currently believe that DTC will once again provide settlement services for transactions in our common stock once the Stock Certificate Litigation is resolved, although there are no assurances DTC will do so. See “Legal Proceedings.”

And remember, these certs were printed and sold through OK brokers Cap Growth and Darbie.

They can certainly make a difference in trading. If not enough clout here, then it can be moved to a federal court and you can't tell me that a federal court can't make it trade! According to a retired Judge from Fort Worth that I spoke with this weekend about all this, he stated that the state court can make a ruling, if the brokers don't comply, then could be and probably would be elevated to federal court and that would do it. Just telling you what I was told.
