I could be mistaken, but in that this is a civil suit, I believe that it's purely a judgement between NWBO and the 7 MM's accused of spoofing. The SEC or other govt. entities aren't involved. I don't believe a settlement could effect the way these MM's conduct their business, however, if the SEC or others are observing what's happening, I don't know that they can't either join the suit, but if not they can certainly pursue their own action. I frankly doubt they will, but that's based on my belief that there will be a settlement before any actual evidence is produced that should clearly show the illegal acts of the MM's.

As of now the MM's moves have forced Posner to reveal her case in dealing with each of the MTD's. Once the MM's are forced to open their books in discovery I suspect that they'll be eager to settle before they're forced to reveal the evidence of how they operate. I don't know when the judge will act, but a settlement shortly thereafter could be very possible. Much of the terms would be clothed in confidentiality agreements, but NWBO certainly would have to show the money they received on their books.
