I’ll have to disagree with much of what you say. All three of the judges who heard and decided the Amarin v. Hikma case were very familiar with patent law. Look at their biographies. Judges Moore and Lourie are each former patent attorneys. Judge McGuire sat by designation; he has heard and decided many patent cases in Texas. Recall that the CAFC has exclusive jurisdiction to hear and decide appeals from District Courts in patent-related cases. Many of the administrative law judges in the PTO are former patent attorneys from law firms or corporate law departments, like Chief Judge Moore and Judge Lourie.
