The FT article made it clear why Cit et all cannot settle.
What NWBO has presented so far is data that shows a lot of sell orders when the price was falling. They showed MMs on both sides of the wire. Duh, that is always going to be be the case.
if they settle, then every OTC is going to look ate their finances and see if there were excess sells the day prior. There would be hundreds of copycat suits.
Assuming NWBO files a reply that gets past the next MTD, this case will go past discovery. Then comes the motions by the defense for summary judgement. If the Judge allows the case to go past that then a settlement might be in play.
That is not this year, nor next year.
