Yes, they were forced to develop their own method and patent it because the one they paid dearly for was a failure. The worst part is that they haven't moved to commercialize CHS so you can say it was double failure. The utility patent was applied for ten years ago this month, it hasn't been denied so I suppose there's still a chance it is approved but then what do they do with it??? If you aren't selling CHS by the trainload, you don't need a patent on scaling it.
