XERI will probably drop its lawsuit against XTI_only_if_and_when_XTI_lives_up_to_its_written_ commitment to fairly compensate XERI for helping pave the way for XTI's merger with INPX. That includes XTI's taking responsibility for paying off the Auctus loan, money which XERI borrowed in order to fund the development of XTI's TriFan 600. Anyone who claims to be concerned about XERI's investors would want them to stick to its guns, rather than hope XERI simply dismisses its lawsuit.
