In addition to this first licensee, we continue to receive strong interest from other potential customers in our innovative device platform and licensing our technologies. We are working hard to close additional commercial agreements by year end, but since, these are long deliberate processes, we can't guarantee that we will do so. We are presently working with a wide spectrum of companies including multinational tier-1 corporations which manufacture data communications network equipment. Several tier-1 manufacturers have also requested to meet and test our polymer modulators, while fiber optic transceiver companies have expressed interest in learning how to implement our polymer modulators into their ongoing 800G transceiver development programs. Also of note, we are planning to implement our PIC designs using commercial semiconductor foundries for multi-channel polymer modulator engines, including 4 channel solutions for 800G. We believe these constructive discussions are positioning us to capitalize on our momentum with additional licensees as we continue to build excitement around our technology.

The BOD should make lebby stay at an EconoLodge and the bearded one should have to sleep in a tent outside the venue. As long as timelines are missed, the perks are missed as well. Lebby should be removed if he has nothing to offer in May. Business is business and being a geek is being a geek. Get me a dealmaker ASAP.

Here we go again, another post from the short peanut gallery on Dr. Lebby misleading folks about a contract by the end of December. Your post is misleading.
He said they were working towards that but he also said " but since these are long deliberate processes, we cannot guarantee we can do so". I believe he was telling us they are close to closing on a contract or two but an issue or issues remain to be agreed upon.

Over the weekend this lead to my musing about what issues are possibly holding things up. Most issues have been agreed upon but issues relating to royalty rates or timing of the contracts could be possible issues to finalize. Here are some of my musings related to what is temporarily holding things up.
Royalty rates are close to agreement but a foundry wants a slightly lower rate to enhance their profit after all the foundry takes more risk on sales than LWLG due to variables in costs which can be affected by different variables going forward and language addressing that could be worked on. Questions about volume discounts, time frames and reasons for exiting the contract could be up for discussion.
There could be questions about exclusivity or partial exclusivity regarding a particular device that the foundry would manufacture.
Questions regarding language in the contract requires review by the Board of Directors and lawyers of both companies and changes need to be negotiated to get to final contract.
There could be a waiting game going on as the foundry or foundries wait for the first one to sign to see what another foundry worked out before coming their agreement.
Waiting can be a negotiating tactic as the foundry knows there is perhaps more urgency by LWLG to get the first contract done.
There could be an agreement on finalizing a contract based a certain date or event (perhaps after a manufactured prototype is ready to be revealed).
A lead customer who was pulling the foundry in may want to have some say on pricing of a device which could lead to further talks to adjust or not to adjust the agreement.

These were some possibilities for some complex negotiating issue that is holding up a final contract. There could be others of course. Each day that goes by brings the companies closer to the need to have a deal in place so that they don't fall behind timeframes to be early enough with transceivers for data centers. This exercise is meant to highlight what complexities have probably been worked out and what could remain.
