Paddy, I may be mistaken. But in their PR, Amarin indicated specifically that the buybacks would be "funded out of distributable profits, in compliance with UK company law regarding distributions and the maintenance of capital".

Additionally, I believe that it is UK law that requires distributable profits (from The Journal of Business ):

Hence, the U.K. Companies Act states that only “distributable prof-
its” or the proceeds of a fresh issue of shares (made for the purpose of the
purchase) can be used to finance the purchase.

But again, maybe I am wrong, and misinterpreting the law, and what Amarain has stated.
