I believe that in the Posner response there is a request to the Court, should they decide to grant MTD, that the Court also give plaintiff leave to file another amended complaint to perfect the case against a future MTD.

He is going to have to decide on the question "How long is an "obvious" length of elapsed time for which spoofing can be held responsible for a depressed share price?"

It appears to me that the slant of his writing while looking favorable to the complaint he will be ruling to satisfy the "Village" where he resides.

In a small "Village" where the Judge was raised educated and now works and lives he would be "turning over the applecart". Overturning the rule of Plutocracy that his "Village" maintains. I believe the all the Judges in this "Village" are loath to put a nail in the coffin (coffers) of the Plutocrats that feed and clothe their community.

The Supreme Court Ruling in favor of Corporations in the infamous Citizens United ruling has been a path now followed by many rulings that large money Corporations are more important than Individuals.

It is not just a spanking that the suit is asking for. It is an acknowledgement of system wide indifference to Individuals in favor of Corporations.

In the initial remarks the Judge said in a roundabout way ... OK spoofing which is against the law is bad but you did not say it was bad enough. It is part of the line from Corporate rule that says ... we don't need to appease or please... cause we got cash flow... and if you want some... remember as KG said ... we decide what is right.

So for one man's opinion to form in opposition to his "Village" survival... it will be easy to say this case does not merit bringing an end to my way of life and my "Village"

I do hope that this is all wrong.
