I imagine that the response from Laura Posner will drop sometime late Friday afternoon on the 12th. Does anyone care to speculate on how long the Judge will then take to issue his decision on the MTD (which I am sure will be denied).

Expect both side to file by Friday, not sure how fast it shows up on Pacer though over a weekend. I would expect the court to fairly quickly note what both parties say and then follow the recommendation as written to grant the MTD (with leave for NWBO to resubmit)..

Why would you be sure it will be dismissed when the R&R calls for it to be granted?

Assuming the MTD is granted ,I expect NWBO is to submit an amended complaint. A few months? Then the defense will file another MTD against that. Probably a reasonably quick time from then as the meat has already been discussed.

Once that round is over, if the case goes forward (which looks likely) they will start a long bickering on how discovery will actually work.

Then discovery.

After that will come the key to the trial. Defendants will move for summary judgement based the issues already brought up but ruled to be not proper at the discovery stage. It is the results of this that will likely determine the "winner". I would though a dart that it is late 2025 or 6.
