If they had applied, they would have been approved. And SURELY they would have informed their shareholders if they had actually applied!

Are you accusing management of withholding that information from shareholders? They would HAVE FAILED TO INFORM SHAREHOLDERS OF MATERIAL INFORMATION for you to be correct, no?
