Judge Du's decision gave Generic Manufacturers the right to produce supply for >500 trigs.
A 10 year trial required by FDA gave Amarin the patent for CV add on protection. Abuse of the skinny label with production intended on infringement has prevented Amarin from benefiting from patent protection for their millions spent on the FDA required trial.
Big Pharma in control would get a jury trial and create severe pressure for generic companies producing quantities clearly intended for infringe use.
Just need to get 5 major doctors that regularly write Rx's for Vascepa to testify their intent of CV protection.
