Technically, it isn't. It IS a violation of SEC regulations. But illegal? No. MMs can do it legally. And an appellate court judge ruled in 1995 that it was not a violation of the securities laws. According to him, it promoted efficient markets. I've always found Scattered to be a very interesting case:
