Pharmacydude sounds right on this. Settlements of this sort are routinely kept secret, but there was extra incentive for the insurance industry to ensure the terms were not disclosed so that other pharmaceutical companies would not see value in suing insurance companies in the future. And Amarin faced risk here as well. The district judge let the case against HealthNet move forward, but he did so at the earliest stage of the litigation, when the judge is required to accept Amarin's claims as true. After discovery and many months and a different standard of law being applied as the case moved down the legal highway, the judge might have dismissed HealthNet from the case just as he did Hikma. And then Amarin would have been left with nothing. Both sides had everything to gain by settling at this point. And Amarin surely gained some scripts as HealthNet changed its formularies.
