no lawyer would do this on a contingency basis unles it was shown that there actually was money/assets that could be accessed. "that could be accessed" being the operative phrase

Having been through a similar suit, I doubt that any lawyer would take any penny stock case on a contingency basis. An experienced attorney (in securities fraud) will cost about about $75-100K.
